Definitions

1) Capitalised words shall have the following meanings:

  1. “BDS” means BD Sport Group, Ltd. “MCG” means My Club Europe Limited
  2. “Draw” means the draw conducted by BDS to determine the winner(s) of Prize(s) for each Lottery.
  3. “Excluded Person” means any person who:
    • is under 16 years of age;
    • has not in any way or form complied with:
      • a) these Terms at the time of entry, as the same may be amended from time to time;
      • b) any other rules of the Lottery provided or published by MCG or BDS;
      • c) any applicable provisions of the Act; or
      • d) any relevant regulations made thereunder from time to time;
    •  Is not a resident Great Britain;
    • is a director, officer, contractor, or employee of MCG or BDS.;
    • is a spouse or dependent of any director, officer, contractor, or employee of MCG or BDS.;
    • Makes any misrepresentation of fact as to the Player’s eligibility, whether intentional or unintentional;
    • the Gambling Commission, MCG or BDS may specify from time to time as being ineligible to participate in a Lottery;
    • MCG or BDS believes, in its sole discretion, is using technology to gain an unfair advantage over other Players; or
    • has voluntarily self-excluded him/herself from the Lottery pursuant to the self-exclusion methods described in these Terms & conditions.
  4. “Grand Prize” means the top prize in any Lottery. There is one (1) Grand Prize awarded in every Lottery. The Grand Prize amount is fifty percent (50%) of the Net Proceeds generated through Ticket sales, up to a maximum Prize of £6,800.
  5. “Help Desk” means the BDS help desk which can be contacted at via the online help form here.
  6. “Lottery” means the society lottery, “My Club Lotto”, operated by MCG and BDS.
  7. “MCG” means My Club Group Limited.
  8. “Net Proceeds” means Proceeds less reasonable expenses incurred to operate the Lottery.
  9. “Online Account” means an account opened by a Player to participate in a Lottery online via the Website.
  10. “Player” means any person who purchases a Ticket in a Lottery online via the Website in accordance with these Terms and who is not an Excluded Person.
  11. “Platform” means the computer system operated by MCG and BDS, or its software suppliers or subcontractors, for the purpose of registering Players, accepting entries for the Lotteries and selecting Winning Numbers.
  12. “Privacy Notice” means the BDS Privacy Notice which is available for review here and the MCG Privacy Notice which can be found here.
  13. “Prize(s)” means any one of the following: a) the Grand Prize or b) a Supporter Prize, depending upon the context in which the term is used.
  14. “Proceeds” means the gross value of all Ticket sales received in connection with a corresponding Lottery.
  15. “Proceeds Cap” means the maximum proceeds for a single draw as required by the Gambling Commission.
  16. “Subscription” An arrangement permitting the purchasing of Tickets on an on-going basis resulting in an entitlement to enter 1 (one) or more Lotteries until such Subscription is terminated.
  17. “Supporter Prize(s)” means multiple cash and non-cash prize(s) that may be added from time to time by MCG and BDS, in its sole discretion, and won by entering a Lottery in accordance with these Terms. The frequency and number of Supporter Prizes may change every Lottery.
  18. “Terms and Conditions” and “Terms” means these terms and conditions.
  19. “Ticket” means a ticket, which contains one or more Ticket Numbers, to participate in a Lottery which is purchased by a Player online via the Website.
  20. “Ticket Number” means the valid number displayed on a Ticket and is entered into the Lottery.
  21. “Website” means the Lottery website hosted by BDS and MCG.
  22. “Winner” means the person in possession of the Winning Number of any Lottery, that has been verified by BDS, and who is not an Excluded Person.
  23. “Winning Number” means a number produced by the Platform’s certified random number generator integrated into the Platform which during the process of selecting the numbers will entitle the holder of a Ticket with a matching Ticket Number to the Grand Prize.
Introduction
  1. BD Sport Ltd. (“BDS”) manages, promotes and offers the Lottery in accordance with these Terms and Conditions (the “Terms”). These Terms shall be effective from December 13th 2019 and shall supersede any previous versions.
  1. The Lottery is operated in compliance with the Gambling Act 2005 (the “Act”) and is licensed by the Tandridge District Council as a small society lottery.
  1. The Lottery is operated and promoted by BD Sport Ltd. (“BDS”) who is an External Lottery Manager (“ELM”) licensed by the Gambling Commission UK (Remote ELM license number 050123-R-327621-004) and also promoted by MCG and in benefit of grassroots amateur sports clubs across the UK who are members of the My Club network (“Member Clubs”). As good cause beneficiaries of the Lottery, Participating Member Clubs receive 34% of the Lottery Proceeds (“Good Cause Proceeds”). Specifically, Good Cause Proceeds from each Ticket sale will go to the Member Club selected by the Player.
  1. The Proceeds Cap for the Lottery is £20,000. Once the Proceeds Cap has been met, Ticket sales shall be closed.
  1. Participating Member Clubs are independent bodies responsible for the management and allocation of the funds they receive as a beneficiary of the Lottery.
  1. All entries into and participation in the Lottery are strictly governed by these Terms. MCG and BDS reserve the right to amend these Terms from time to time and shall publish the most up-to-date version on the Website.
  1. By entering the Lottery, a Player agrees to be bound by these Terms as published on the Website as of the date of entry.
  1. These Terms are published on the Website. MCG and BDS will provide a written copy of the Terms by post if requested to do so upon receipt of a stamped, self-addressed envelope. Requests should be mailed to:

  1. The Terms may be amended by BDS and MCG from time to time. Any amended Terms will be published on the Website. If a Player is not satisfied with any proposed amendments, they can cancel their Subscription at any time in accordance with the Terms.
  1. Players can participate online via the My Clubs website (the “Website”) and select the Member Club it wishes to support. 34% of the Lottery Proceeds from each Ticket sale will go to the Member Club selected by the Player.
  1. Players should play responsibly. Information on how to gamble responsibly and how to access information about problem gambling and how to obtain help can be found on the Website. Additionally, information is available from www.gamcare.org.uk.
Conditions of Entry
  1. To enter the Lottery, and to be eligible to win any Prize, a person must:
    • be 16 years of age or over;
    • comply with these Terms at the time of entry, as the same may be amended from time to time; any other rules of the Lottery provided or published by MCG or BDS; any applicable provisions of the Act; and any relevant regulations made thereunder from time to time; and
    • not be an Excluded Person.
  2. By purchasing a Ticket, Players acknowledge and agree i) to these Terms, and that ii) a minimum of twenty percent (20%) of the Ticket price will go to the Member Clubs pursuant to the Terms. At this time, thirty four percent (34%) of the Ticket price will go to the Member Club selected by the Player.
  3. MCG and BDS will determine, in their sole discretion, relying on their own technical records, when determining whether a Player is eligible to receive a Prize and designated as a Winner in accordance with these Terms.
  4. MCG and BDS reserve the right to refuse any entry to the Lottery if it has reasonable grounds to believe that these Terms, or any applicable provisions of the Act, have not been complied with.
  5. MCG and BDS reserve the right to withhold any Prize and not designate a Winner if it has reasonable grounds to believe that these Terms, or any applicable provisions of the Act, have not been complied with.
How to Enter The Lottery
  1. Players can enter the Lottery using the Website in two (2) ways: i) by creating an Online Account and signing up for a monthly Subscription; or ii) by making one-time Ticket purchase on a non-Subscription basis.
  1. All Players acknowledge and agree that they must affirm their age and agree to these Terms before they can purchase a Ticket. BDS reserves the right to refuse sales to anyone who they believe is an Excluded Person or is otherwise not eligible in accordance with these Terms.

– Subscriptions

  1. Signing up for a Subscription constitutes the Player providing its ongoing authorisation to BDS to collect payment for the next scheduled Lottery from the Player’s designated payment method, until this authorisation is revoked. Payments for Tickets will be processed using the Player’s nominated payment method immediately when the Player first signs up for the subscription, and then on the Wednesday of each week thereafter as long as the subscription is active. Collected payments from the Player’s designated payment method purchase the Ticket(s) with the requested quantity of Ticket Number(s) into the next scheduled Lottery following the collected payment.
  1. The application for Subscription will require the Player to create an Online Account and provide the following information:
  • The amount of money they wish to spend on the monthly subscription. £5, £10, £20, or £50;
  • Your name, full address, email address, telephone number and date of birth; and
  • Your valid payment details.
  1. Creation of an Online Account and Subscription is subject to the approval of BDS pursuant to the Terms.
  1. BDS reserves the right to terminate or suspend a Subscription for any reason at any time in its sole discretion including but not limited to: if there are concerns over activities on the Online Account, if there are concerns that the Player is an Excluded Person, or if the Player makes a dispute or chargeback on any payments made from an Online Account.
  1. If the Player wishes to amend the number of Tickets or Ticket Numbers they have subscribed to, they may do so by logging into their Online Account and making the appropriate changes before the next Draw.
  1. Subscriptions continue on a rolling basis until terminated by the Player or by BDS. 
  1. Players can terminate their subscriptions at any time by logging on to their Online Account. 

– Ticket Purchases

  1. Information about the price of Tickets will be displayed on the Website. There are no price discounts for purchasing multiple Ticket Numbers.
  2. Depending on how many Ticket Numbers have been purchased, each Ticket will set out one or more Ticket Numbers for the Lottery.
  1. Up to 105 Ticket Numbers can be purchased per online purchasing session.
  1. A Ticket will be valid only for the Draw to be held on the date(s) shown on the face of the Ticket. It is the Player’s responsibility to check at the time of purchase that the date of the Draw on their Ticket is as requested.
  2. Ticket Numbers are issued at random and not chosen by the Player.
  1. The Player is solely responsible for ensuring that the Ticket remains safe and in a good and legible condition.
  1. MCG and BDS accept no responsibility for lost, stolen, damaged or defaced Tickets. Prizes will not be awarded where the relevant Ticket cannot be produced.
Refund Policy
  1. Ticket purchases are non-refundable unless the Player wishes to self-exclude, in which case BD shall make best efforts to refund any Tickets for the self-excluded Player that have been purchased for the corresponding Draw, though a refund is not guaranteed. Where a refund is possible, BD shall cancel the refunded Ticket Numbers and remove them from the Lottery.Where a refund is not possible, the Ticket Numbers shall remain in the Lottery. Each Player accepts that if their application for a refund is accepted, their Ticket will be withdrawn from the applicable Lottery and will not be eligible for any Prizes.
  1. Ticket purchases cannot under any circumstances be refunded after the closing of Ticket sales of a Lottery to which the particular Ticket relates.
Payment Method
  1. The only methods of payment accepted for Subscription or one-time Ticket purchases is Debit card.
  1. Player credit card details are not stored on the platform. A token is stored in place of the credit card details and used to purchase Tickets.
  1. Should the Player’s payment card expire, the Player may update their payment card details through their Online Account.
  1. If BDS is unable to collect a Player’s payment on the applicable collection date BDS may, but has no obligation to, make up to 3 (three) further attempts to collect the payment prior to the next Draw. No Ticket Number(s) will be purchased or entered into a Draw unless BDS has received all amounts payable for the Ticket(s) relating to such Ticket Number(s) in cleared funds in advance of the Draw. BDS accepts no responsibility for any loss or damage caused as a result of Ticket Number(s) not being purchased or entered in a Draw where BDS sought payment and the Player’s payment method failed.
Players and Player Account
  1. It is a condition of entering a Lottery, that all Players must be residents of Great Britain (for avoidance of doubt, this excludes Northern Ireland). Players agree that by entering a Lottery or whilst located anywhere other than Great Britain is strictly prohibited. In such circumstances:
    • a) the Person shall be considered an Excluded Person; and
    • b) MCG and BDS each have the right to terminate the Online Account and withhold any Prizes.
  1. In order for MCG and BDS to determine whether a Player is eligible to open an Online Account, the Player must supply MCG and BDS with certain personal information specified by MCG and BDS (such as their name, home address details, date of birth, and e-mail address).
  1. MCG and BDS reserve the right to carry out further checks or request information from a Player before, during, or after registration for an Online Account to verify that the Player and the information supplied by Player meets the eligibility criteria set out in these Terms and this shall be done in accordance with each company’s Privacy Notice.
  2. Players may be asked if they wish to be contacted for advertising, promotional and marketing purposes in accordance with the terms of each company’s Privacy Notice. If Players wish to be removed from MCG and BDS mailing lists, they should click on the unsubscribe link shown on all distributed e-mails or in their Online Account. They may also contact the Help Desk.
  1. Players are responsible for keeping their login details secure. Players must inform BDS immediately of any unauthorised access to an Online Account. Should a Player forget their password, the Player must follow the instruction details on the registration or login page in order to obtain a new password.
  1. It is the responsibility of the Player to ensure that the information supplied by the Player is accurate and up to date.
  1. A Player may close an Online Account at any time. Players may close their Online Account using the ‘Close Account’ function, or alternatively contacting the Help Desk to confirm the closure of the account in writing.
  1. MCG and BDS reserve the right to retain personal details for reasonable legal and regulatory purposes after an Online Account is closed in accordance with each company’s Privacy Notice.
  1. BDS reserves the right to terminate a Player’s Online Account at any time, in its absolute discretion (for example where BDS discovers that a Player was not, or is no longer eligible, to open an Online Account).
  1. BDS, in its absolute discretion, may terminate, vary or suspend any provision of the Lottery or access to an Online Account without prior notice:
    • a) on breach of these Terms;
    • b) for maintenance work required to upgrade or update the Platform;
    • c) if MCG and BDS cease to offer Lotteries; or
    • d) for any other reason at MCG and BDS’s sole and reasonable discretion.
The Draw and Prizes
  1. The maximum aggregate value of all Prizes offered in connection with a Lottery shall not exceed £25,000.
  1. The Draws will take place weekly
  1. Subject to verification and eligibility confirmation by MCG and BDS, the results of a Draw will be published on the Website and a Prize shall only be awarded to a Player holding a Ticket which has the Ticket Number matching the selected Winning Number(s) by the Platform.
  1. For each Draw, the Winning Number will be chosen randomly from all the valid Ticket Numbers that have been purchased for that Draw.
  1. The Winning Number(s) for the Grand Prize will be chosen randomly first.
  1. The Winning Number(s) for the Supporter Prize(s) will be chosen randomly immediately after the drawing of the Grand Prize.
  1. Subject to Terms, where a Ticket Number matches a Winning Number, Prizes will be paid to the holders of Tickets with those matching Ticket Numbers as follows:

– If a Winning Number for a Grand Prize is matched by the Ticket Number on a Player’s Ticket, the Player will win a Prize equal to fifty percent (50%) of the Net Proceeds of the Lottery;

– If a Winning Number for a Supporter Prize is matched by the Ticket Number on a Player’s Ticket, the Player will win the relevant Supporter Prize.

  1. Players who believe they have won a Prize should contact the Help Desk.
  1. Any Player with a Winning Ticket Number will be required to provide proof of their identity, age, residency, and compliance with these Terms to BDS before the Prize is awarded. No Prize will be awarded to a Player that fails BDS’ verification and eligibility process.
  2. Once the Player with the Winning Ticket Number is verified as eligible to receive the Prize, he or she shall be declared the Winner.
  1. BDS will only pay out Prizes to Winners by cheque or electronic transfer to a UK bank account after verifying the Player’s identity and eligibility to win. The identity details of any bank account nominated to receive Prize winnings must match Player identity details.
  1. No Prize will be paid on a Ticket that has been forged, altered, damaged or defaced in any way.
  1. No Prize will be paid on a Ticket that fails MCG and BDS validation process.
  1. Where a Prize is paid to an Excluded Person, a person in breach of these Terms, or is otherwise paid in error, the Prize must be repaid immediately to BDS.
  1. BDS shall provide the Prize payment to the Winner within fourteen (14) business days of receiving satisfactory proof of the Player’s identity and eligibility, and validation of the Winning Number on the Ticket submitted for verification. MCG and BDS will not be liable for late payments resulting from inaccuracies of payment details provided by a Player, or any rejection of payments caused by the Player’s bank.
  1. Each Winner is responsible for paying any and all taxes due on any Prize(s) won. MCG and BDS will not be responsible for paying any taxes due on the Prize for or on behalf of the Winner.
  1. Prizes must be claimed no later than 12:00pm one hundred and eighty (180) days following the day of the Draw.
  1. Any Prize not claimed within one hundred and eighty (180) days of the Draw will be forfeited and may be rolled over into future Prizes or donated to Member Clubs.
  1. No Prize substitution will be allowed except in BD and MCG’s sole discretion. If Winner is not able to accept Prize, Winner shall forfeit the Prize. Non-cash Supporter Prizes cannot be redeemed for cash.
  1. Except when required to do so by law, MCG and BDS will not make information about Winners public without first obtaining their written consent.
  1. Any questions relating to any Lottery Draw should be communicated to the Help Desk.
Self-Exclusion
  1. Any Player has the option to notify MCG and BDS at any time that they wish to be excluded from purchasing Tickets for future Lotteries by visiting the Website. Requests for self-exclusion are activated immediately, however the Player has the ability to cancel the self-exclusion request after a 24-hour cooling off period. At the start of the period of self-exclusion, the Online Account will be closed.
  1. Players may choose the length of the period during which they will be excluded from purchasing Tickets (the “Exclusion Term”), subject to a minimum period of six (6) months. During the Exclusion Term, Online Players will not be permitted to access their Online Account or to purchase any Tickets using that account or an email address attached to the account.
  1. Requests for self-exclusion are activated immediately, although if at the point the self-exclusion is processed funds from the relevant Online Account have already been collected for the next upcoming monthly Draws (or a request to the payment provider has already been sent for collection for these upcoming monthly Draws) BDS may be unable to remove the ticket from those Draws. In such circumstances payment for those Draws will not be refunded, and any wins resulting from such Draws will be paid out in the normal manner.
  1. When a Player self-excludes, the Help Desk will provide the Player with a customer GamCare leaflet or information and suggest a telephone call to the GamCare National Helpline.
  2. BDS will not contact the Player at the expiration of the Exclusion Term. At that time, the Player’s Online Account will continue to be inactive for seven (7) years until the Player contacts BDS to reactivate the Online Account. Once the Player has contacted BDS to reactivate the Online Account, BDS shall contact the Player after a 24-hour cooling-off period to confirm the reactivation.
  1. The Player may choose to enter another Exclusion Term at any time.
  1. Players who have opted to self-exclude under this Clause will not receive marketing materials from MCG or BDS.
  1. A Player may also use the unsubscribe link at the bottom of any marketing email to stop any further marketing communications.
Limitation of Liability & Reservation of Rights
  1. Nothing in these Terms shall exclude or limit MCG and BDS’s liability for fraudulent misrepresentation or death or personal injury resulting from MCG or BDS’s gross negligence, or for any other liability that cannot be excluded or limited by law.
  2. Neither MCG nor BDS will be liable for any loss or damage, including the loss of opportunity to enter a given Lottery and/or the right to receive a Prize(s), suffered by a Player if such Player has not complied with these Terms.
  3. Subject to Clause 80, neither MCG, BDS, nor the Member Clubs shall be liable in contract, tort (including but not limited to negligence), or otherwise in connection with the Lotteries for:
    • a) loss of revenue, contract, profits, business or anticipated savings or loss of data;
    • b) any special or indirect or consequential losses;
    • c) any loss of goodwill or reputation; or
    • d) the loss of opportunity to enter a Lottery and/or right to receive a Prize.
  4. Subject to Clause 80, MCG and BDS’s liability to any Player shall be limited to the amount of any Prize which may have become due to that Player upon confirmation of that Player as a Winner.
  1. MCG and BDS make no warranty, representation or guarantee that use of the Websites, Platform, Help Desk, telephone system, and broadcasts or live transmissions will be uninterrupted, timely and/or error-free.
  1. Where the Website contains links to other sites and resources provided by third parties, these links are provided for the Player’s information only. Such links should not be interpreted as approval by MCG or BDS of those linked websites, the content of those websites, or information a Player may obtain from them. MCG has no control over the contents of those sites or resources, and links from the Website should not be interpreted as an endorsement in any way by MCG, BDS, or the Club.
  1. Nothing contained in these Terms shall affect the statutory rights of any Player, MCG, BDS or the Member Clubs.
Intelectual Property
  1. The Player acknowledges that, as between the Player and MCG and BDS, all intellectual property rights in the Lottery throughout the world belong to MCG and BDS, and its affiliates, and that the Player has no intellectual property rights in, or to, any Lottery, the Website or the Platform.
Data Protection
  1. All information provided by Players to MCG and BDS for the purposes of the Lottery will be stored, managed and used in accordance with each company’s Privacy Notice.
Governing Law
  1. These Terms are governed by and construed in accordance with the laws of England and Wales and shall be subject to the jurisdiction of the English and Welsh courts. However, if a Player lives in Scotland, the Player can bring legal proceedings in in either the Scottish or the English courts.
Insolvency
  1. BDS and MCG have implemented measures to ensure that Player payments are held in a separate non-designated client account which is separate from BDS’ and MCG’s other banking facilities to ensure that, in the event of BDS and/or MCG ceasing to trade, such Player payments do not form part of their assets and will be protected. This meets the Gambling Commission’s requirements at the medium segregation level because BDS and MCG hold Player payments separate from their own funds. This means that steps have been taken to protect Player payments but there is no absolute guarantee that they will be repaid if BDS and/or MCG should at any time become insolvent.
Complaints
  1. Any complaints relating to the Lottery should be filed as provided below. All complaints relating to a particular Lottery must be received within 3 (three) months of the relevant Lottery date. Records of complaints will be kept by BDS for 3 (three) years.
  1. Players can file a complaint as follows:
  • Stage 1 – The Player can contact the Help Desk via any of the methods listed below. BDS aims to respond within 48 hours.
  • Stage 2 – If the Player is dissatisfied with the solution provided, the complaint will be escalated internally to a dispute.
  • Stage 3 – Should the Player still feel they have not received an acceptable solution, the dispute will be escalated to an escalated dispute internally to Legal and Compliance.

  • Stage 4 – If the Player is unhappy with the solution offered from BDS and the matter is regarding the lottery, the Player can contact the Independent Betting Adjudication Service (IBAS).

Independent Betting Adjudication Service (IBAS) is an Alternative Dispute Resolution (ADR) service, approved by the Gambling Commission to provide informed and impartial adjudications on disputes that arise between licensed gambling operators and their customers, after the customer has completed the operator’s own internal dispute procedures and where a deadlock still exists.

Customers must follow the BD Sport Ltd complaints process prior to contacting IBAS.

Terms and Conditions of Entry

  • Information on how to enter and on the promotion form part of these conditions.
  • The £10 My Club Shop voucher is available to all customers who purchase a £5 ticket by means of subscription to My Club Lotto.
  • Subscription purchases higher than £5 will be valid, though will activate a single voucher. Multiple vouchers will not be offered for subscription amounts of more than £5.
  • Customers who purchase a My Club Lotto ticket(s) by means of Instant Play and do not have an active subscription will be exempt from this promotion.
  • Customers who subscribe to My Club Lotto will be automatically entered into future My Club Lotto draws by means of a continuous payment authority.
  • No additional purchase is necessary.
  • Multiple entries are not allowed. This includes the creation of new My Club accounts for the same person.
  • All entrants must be aged 16 or over and physically based in the UK.
